US court urged to reject FDA bid to regulate e-cigarettes as devices

A legal petition by the US Food and Drug Administration to regulate electronic cigarettes as medical devices has come under criticism by the Washington Legal Foundation, a public interest law and policy centre1,2.

E-cigarettes are not medical devices because they are not promoted for any therapeutic use, the WLF argues in an amicus brief filed before an appeals court, which is due to hear the case in September...
