EU advocate general condemns financial incentives for prescribers

European Court of Justice Advocate General Niilo Jääskinen has issued an opinion that puts the brakes on a UK health service scheme to control healthcare expenditure through a specific form of drug substitution1. In Association of the British Pharmaceutical Industry v Medicines and Healthcare products Regulatory Agency, the advocate general also makes it clear that providing financial incentives to influence prescribing practices is unlawful not only for commercial concerns, but also for state authorities...
